1. General Information

These Terms and Conditions ("Terms") govern the contractual relationship between Hrebenda Fine Art ("Seller", "we", "us") and any individual or legal entity ("Client", "you") purchasing fine art photographic prints through this website.

Hrebenda Fine Art is a platform presenting and selling premium fine art photographic prints created by Filip Hrebenda("Author"). By accessing this website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

All artworks offered through this website are premium fine art prints, and are intended for collectors, private clients, and professional interior projects.

2. Nature of the Artwork

All photographs offered for sale are original fine art works created by Filip Hrebenda. Unless explicitly stated otherwise, all prints are offered as limited editions.

Each fine art print:

  • Is produced in a strictly limited number of copies
  • Is signed by the author
  • Is accompanied by a certificate of authenticity
  • Is produced using museum-grade printing processes and archival materials

Due to the artistic and limited nature of the works, minor variations in color or appearance may occur depending on lighting conditions and display environment. Such variations do not constitute a defect.

3. Orders and Contract Formation

By placing an order on this website, the Client submits a binding offer to purchase the selected artwork. A purchase contract is formed only after the Seller confirms the order via written confirmation (email).

The Seller reserves the right to refuse or cancel an order at its discretion, particularly in cases of suspected fraud, pricing errors, or limited edition availability conflicts.

4. Pricing and Payment

All prices are listed in the currency specified on the website and do not include any applicable customs duties, import taxes, or local fees unless explicitly stated.

Full payment is required prior to production and shipment of the artwork. Accepted payment methods are specified during checkout.

Due to the high value and limited nature of the artworks, installment payments or custom arrangements may be available only upon prior written agreement.

5. Production and Delivery

Fine art prints are produced on demand after order confirmation to ensure the highest quality standards.

Estimated production and delivery times are provided for guidance only and may vary depending on print size, destination, and external factors such as customs clearance.

Artworks are carefully packed using professional, protective packaging designed for high-value art shipments.

6. Delivery Damage and Claims

Upon receipt of the shipment, the Client is obligated to inspect the artwork without delay.

In the event that the artwork arrives damaged, the Client must:

  • Notify the Seller without undue delay after delivery
  • Provide clear photographic documentation of the damage, including packaging and the artwork itself

Once notified, the Seller will provide immediate assistance and coordinate an appropriate resolution. The damage will be compensated either through repair, replacement, or refund, depending on the circumstances and availability of the artwork.

7. Returns and Cancellations

Due to the bespoke and limited-edition nature of fine art prints, returns are generally not accepted.

Cancellations may be possible only before production has begun and must be requested in writing. Once production has started, cancellation is no longer possible.

Exceptions may be made solely at the Seller’s discretion.

8. Intellectual Property Rights

All intellectual property rights to the artworks, including copyrights, remain exclusively with the Author, Filip Hrebenda.

The purchase of a fine art print does not transfer reproduction, commercial, or distribution rights. The Client acquires only the physical artwork for personal or non-commercial display.

Any reproduction, resale, licensing, or commercial use of the artwork without prior written consent is strictly prohibited.

9. Limitation of Liability

The Seller shall not be liable for indirect, incidental, or consequential damages arising from the use, display, or inability to use the purchased artwork, except where liability cannot be excluded under applicable law.

The Seller’s total liability shall in all cases be limited to the purchase price paid for the artwork.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws applicable to the Seller’s place of business, unless otherwise required by mandatory consumer protection laws.

Any disputes arising out of or in connection with these Terms shall be resolved primarily through mutual agreement. If no agreement is reached, disputes shall be subject to the competent courts.

11. Final Provisions

The Seller reserves the right to update or modify these Terms at any time without prior notice. The version in effect at the time of order placement shall apply.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain fully effective.
